Messaging Terms

Consent, opt-out, and program details for text messages sent through Local SEO Ranker.

These Messaging Terms (“Messaging Terms”) govern SMS and MMS text messages sent through the Local SEO Ranker platform operated by Devtech, LLC (“Local SEO Ranker,” “we,” “us”). They apply to (a) our customers who use the platform to send messages (“Businesses”), and (b) people who receive those messages (“Recipients”). They supplement our Terms of Service and Privacy Policy.

For message recipients

Program description

Local SEO Ranker sends text messages on behalf of local businesses you have done business with or interacted with. Messages are sent from a phone number operated by Local SEO Ranker and will identify the business on whose behalf they are sent. Message types include: review and feedback requests after a purchase or service visit, appointment and service follow-ups, responses to your inquiries, and, only where you have separately agreed to receive them, promotional offers from that business.

Consent

You will only receive messages if you provided your mobile number to the business and agreed to receive text messages from it, for example by checking a box on a form, replying to a keyword, or giving verbal consent that the business recorded. Consent to receive messages is not a condition of any purchase.

Message frequency

Message frequency varies by business and by your interaction with it. Typical programs send 1–4 messages per month. Recurring marketing messages are sent only with your separate consent.

Message and data rates may apply according to your mobile carrier plan.

How to opt out

Reply STOP to any message to unsubscribe. You will receive one final confirmation message and no further messages will be sent to you from that number. You may also opt out by emailing info@mylocalseoranker.com with your mobile number. Because our sending number is shared across businesses on our platform, replying STOP stops messages from all businesses using that number. To receive messages again, reply START or provide new consent to the business.

Your information

We use your mobile number and message history only to deliver messages on behalf of the business, to honor opt-outs, and to comply with carrier and legal requirements. We do not sell your mobile number, and mobile opt-in data and consent are never shared with third parties or affiliates for their own marketing purposes. Supported carriers

Messages are supported on major U.S. and Canadian carriers, including AT&T, T-Mobile, Verizon, US Cellular, and regional carriers. Carriers are not liable for delayed or undelivered messages.

For businesses using messaging features

1. Sending number and sender responsibility

Messages are sent from phone numbers owned and registered by Devtech through Twilio, under Devtech’s brand and campaign registrations with The Campaign Registry (A2P 10DLC) or toll-free verification. Because the number is shared and registered under our name, carrier complaints and violations attributable to your account affect every business on the platform. Accordingly, you agree to follow these Messaging Terms strictly, and we may suspend your messaging immediately, without notice, for any violation or for unusual complaint, opt-out, or carrier-filtering rates.

2. Consent requirements

Before sending any message to a Recipient through the platform, you must have obtained and be able to document the Recipient’s prior express consent (for informational/transactional messages) or prior express written consent (for marketing messages) as required by the Telephone Consumer Protection Act (TCPA), FCC rules, the CTIA Messaging Principles and Best Practices, and applicable state laws (including state “mini-TCPA” laws) and, for Canadian recipients, CASL. Consent must:

3. Content rules

Every message must identify your business. You may not send content that is prohibited by carriers or Twilio, including: messages related to SHAFT categories (sex, hate, alcohol, firearms, tobacco/cannabis) except as expressly permitted and age-gated; high-risk financial services, debt collection, or lead-generation content; gambling; illegal substances; phishing, fraud, or deceptive content; or content that uses public URL shorteners. Do not “snowshoe” (spread similar traffic across multiple numbers to evade filtering). Marketing messages may be sent only between 8:00 a.m. and 9:00 p.m. in the Recipient’s local time unless a stricter state law applies.

4. Review solicitation

Review requests must comply with the Federal Trade Commission’s Consumer Reviews and Testimonials Rule (16 CFR Part 465) and the review platform’s policies. You may not offer incentives in exchange for reviews, selectively solicit reviews based on expected sentiment (“review gating”) where the platform prohibits it, or request that Recipients alter or remove honest reviews.

5. Opt-outs and HELP

The platform automatically processes STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, and HELP keywords and maintains a platform-wide suppression list. You must honor opt-out requests received through any other channel (email, phone, in person) within 10 business days by marking the contact as opted out in the platform. You may not contact an opted-out Recipient by text again unless they provide new, documented consent.

6. Your data obligations

You are the business whose customers receive messages. You are responsible for providing Recipients with a privacy notice that covers the collection of their mobile numbers and the sharing of those numbers with service providers like us. You must not share Recipient opt-in data with third parties for their marketing purposes. You agree to cooperate with any investigation by us, Twilio, carriers, or regulators.

7. Fees and limits

Messaging allowances and per-segment overage fees are described on the Pricing page or in your order form. A “segment” is 160 GSM-7 characters (70 UCS-2 characters if emoji or special characters are used); longer messages use multiple segments. We may impose daily sending limits and throttle delivery to comply with carrier throughput rules.

8. Liability and indemnity

You are solely responsible for messages sent from your account and for all claims, fines, carrier penalties, and costs arising from them, including claims under the TCPA (which provides statutory damages of $500 to $1,500 per message). You agree to indemnify and hold harmless Devtech, LLC, Twilio, and the carriers from any such claims, as further described in Section 14 of the Terms of Service.

9. Changes

Carrier and regulatory requirements change frequently. We may update these Messaging Terms at any time by posting the revised version here; material changes will also be communicated by email or in-app notice.
